Texas Law Requires an Agreement, So Choose Your Buyer’s Agent Carefully
As of January 1, 2026, Texas law generally requires you to sign a written agreement with a real estate license holder before that agent can show you a residential property.
This is not an optional form invented by real estate agents, and it is not paperwork that can simply be handled later. A written agreement must generally be in place before the showing, or, if no property is shown, before an agent presents an offer on your behalf.

Because you must sign an agreement, deciding which agent to work with deserves serious consideration.
Not Every Agreement Gives You Representation
The law allows a representation agreement or a limited, non-representation agreement. These agreements do not provide the same relationship or level of service.
A non-representation agreement may allow an agent to show you a property without representing your interests. A listing agent can also show you a home, but that agent represents the seller. NOT YOU!
Before signing anything, ask:
Will you represent me and protect my interests as the buyer?
Do not assume the answer is yes simply because an agent opens the door.
You Are Signing a Binding Agreement
A buyer-representation agreement is a contract between you and the broker. Depending on its terms, it may determine:
01 Whether the relationship is exclusive
02 The properties or geographic area covered
03 How long the agreement remains in effect
04 The services the broker will provide
05 How the agreement may be terminated
06 How the broker will be compensated
07 Whether you could owe compensation at closing
Broker compensation is not set by law and is fully negotiable. A seller may agree to pay some or all of the buyer broker’s compensation, but that is not guaranteed.
Never sign until you understand the services, compensation, length and termination provisions. If an agent rushes you, avoids your questions or cannot explain the agreement clearly, consider that a warning.
The Agent You Choose May Affect Your Entire Purchase
If you make an offer, you could become legally bound to a seller you do not know. The purchase contract will contain deadlines, payments, notices and obligations that can affect your money, your right to terminate and your responsibility to complete the purchase.
A knowledgeable buyer’s agent should be able to:
01 Analyze comparable sales and property history
02 Explain the risks within an offer
03 Structure price and terms strategically
04 Understand the contract and its deadlines
05 Coordinate inspections and specialist evaluations
06 Monitor financing, appraisal, insurance and title
07 Recognize concerns before they become serious
08 Know when additional professional or legal advice is needed
A buyer’s agent does far more than locate homes and schedule showings. Once you are under contract, that agent’s knowledge and attention can become critical.
